Decisions re complaints against Chief Kahsennenhawe Sky-Deer

10/25/2011

The Mohawk Council of Kahnawà:ke wishes to inform the community that the disciplinary measures process regarding the three complaints against Chief Kahsennenhawe Sky-Deer has been completed.  All three complaints were made by the same community member against Chief Sky-Deer.

The investigator appointed in the process, attorney Lysane Cree, presented her final report with recommendations at a duly convened meeting of Chief & Council on Monday, 24 Kenténha/October.

While there was one report, the three complaints were handled separately.

The investigator’s report did not find any wrongdoing on the part of Chief Sky-Deer in Complaints #1 and #3.  For Complaint #2, the investigator found Chief Sky-Deer did act inconsistent with her responsibilities and recommended that an Act of Censure be passed.  Three separate secret ballot votes took place. Chief and Council voted unanimously against any Act of Censure for Complaint #1 and unanimously against any Vote of Non-Confidence for Complaint #3.  For Complaint #2, Chief and Council voted 5-3 in favor of an Act of Censure.

As per section 5.9 of the Disciplinary Measures Regulations, an Act of Censure requires the support of seven (7) elected Chiefs of the Mohawk Council of Kahnawà:ke. As this was not reached, no Act of Censure was passed.

As per the Disciplinary Measures Regulations, the matter is now considered closed.
