MCK receives favorable decision in A30 Court Case

08/02/2017

The Mohawk Council of Kahnawà:ke (MCK) wishes to advise Kahnawa’kehrò:non that the decision from the Superior Court in the matter of MRC de Roussillon et al. v. Minister of Natural Ressources et al.

The Court provided a decision that appears to be quite favorable to Kahnawà:ke on all fronts.

The case, which was brought forth by the communities surrounding Kahnawake, alleged that Quebec did not properly consult with those communities in deciding to transfer the lands within their boundaries along the A30 that Quebec agreed to return to Kahnawà:ke as compensation for the A30 bypass project which comprised of approximately 700 acres of land within the Seigneury of Sault St. Louis land grievance.

The court case has prevented Kahnawake from taking full and formal possession of 500 acres on lands on the ‘Kahnawake side’ of the A30.

“While we are no doubt very pleased with this news, we have to actually analyze the decision and plan our next steps,” said Grand Chief Joseph Tokwiro Norton. “Chief & Council will need to meet as a group before we are able to provide our official position on this important matter.”
