MCK Served with Notice from Myiow’s Lawyers
07/02/2009
The Mohawk Council of Kahnawà:ke (MCK) has announced that Chief & Council were served with a notice in regard to their rejection of the Federal Court’s order.
According to the notice, Keith Myiow’s attorneys will “take all recourses available seeking the observance of the Injunction including a Contempt of Court.”
On Tuesday evening, 30 Ohiarí:ha/June, the Federal Court ordered “the Electoral(s) Officer(s) of the 2009 Election of the Mohawk Council of Kahnawake and the Mohawk Council of Kahnawake” to place Mr. Myiow’s name on the ballot as a candidate for Grand Chief.
The MCK wishes to remind the community that it does not have the right to comply to the Federal Court order as the Kahnawà:ke Electoral Law clearly states that any and all decisions pertaining to a person’s eligibility in an election are the sole responsibility of the Electoral Officer. By accepting this order, the MCK would not only fail to defend Kahnawà:ke’s jurisdiction but would, in fact, be in breach of the community’s own law.
In regard to the notice, the MCK says it stands firm in its resolve to defend Kahnawà:ke’s jurisdiction.
