MCK Served with Notice from Myiow
07/16/2009
The Mohawk Council of Kahnawà:ke (MCK), along with all current members of Chief & Council and others, were served by bailiff this morning with a “Notice of an application for a judicial review and a motion for an interim and interlocutory injunction” by Mr. Keith Myiow.
This Notice of Motion, made to the Federal Court, is set for 27 Ohiari’kó:wa/July or as soon thereafter as it can be heard.
Mr. Myiow is asking for, amongst other things, that the 2009 MCK election be declared illegal, void and null; that all members of Chief & Council be removed from office; that a new election be held and that the Federal Court order that he be placed on the ballot for Grand Chief be enforced; that the Federal Court order the appointment of independent electoral officers, chosen by the Federal Court, for such an election and that the MCK Election Law and MCK Disciplinary Regulations be declared illegal, void and null.
He is also asking that the Federal Court grant an interim and an interlocutory injunction that would maintain the previous Chief & Council, including himself as a Council Chief, until a new 2009 MCK election takes place.
“It continues to disappoint Chief & Council that this man chooses the Federal Court in matters such as this,” said Grand Chief Michael Ahríhrhon Delisle, Jr. “We have a position that is consistent with that of the community and we will maintain it throughout this disturbing ordeal. We have a law created by our people, for our people and we will defend it.”
