Mediated Agreement Reached by MCK, Myiow

The Mohawk Council of Kahnawà:ke announced an agreement was reached today with Mr. Keith Myiow in regard to his lawsuit against the MCK. As part of the settlement, the MCK:

“…will make a public declaration which will be publicized through the media…to the effect that an agreement of settlement has been reached with Mr. Keith Myiow and that the vote of non-confidence held on October 29, 2007 in regard to Mr. Myiow is without further effect in respect of his standing and eligibility for any eventual election for which he may be nominated to run. Mr. Myiow will make a public declaration which will be publicized through the media…to the effect that an agreement has been reached with the MCK and that Mr. Myiow recognizes the present Mohawk Council of Kahnawà:ke and its Grand Chief, and that they were duly elected in accordance with the MCK Election Law and that he withdraws any and all claims and allegations he made in HRSDC complaint for unjust dismissal, the appeal proceedings before the Court of Kahnawà:ke and Federal Court proceedings, as well as all other allegations made publicly by Mr. Myiow against the MCK, its current and past chiefs and its Grand Chief.”

Further, the agreement states that:

“Mr. Keith Myiow recognizes that the MCK, its current and past chiefs and its Grand Chief have acted and are acting in the best interests of the community.

As well, the agreement stipulates that the MCK will pay Mr. Myiow, without admission of liability and solely in the interest of settling the longstanding dispute, an indemnity in the amount of $135,000. This amount is roughly equal to the salary Mr. Myiow would have received had he remained in office. In turn, Mr. Myiow withdraws his proceedings before HRSDC and the Federal Court.
