Application to Institute Proceedings by “The Kannabis Shop”

MCK

The Mohawk Council of Kahnawà:ke (MCK) wishes to inform the community that it has been served with an Application to Institute Proceedings filed in the Quebec Superior Court by a community member, doing business as “The Kannabis Shop” (TKS).

The plaintiff (TKS) is seeking $15,296,000 in damages for expenditures and potential business opportunities lost, alleging that representations and assurances induced TKS to proceed with a cannabis project.

The MCK strongly refutes the allegations set out in the application and will take all necessary legal steps to oppose the proceedings.

The plaintiff (TKS) previously filed an application in the Federal Court against the MCK and the Kahnawà:ke Cannabis Control Board (KCCB) on July 25, 2025, seeking a judicial review of the KCCB decision denying TKS a standard processing license. Following an unsuccessful motion for production of documents, which awarded costs to the MCK, the plaintiff discontinued that proceeding on March 16, 2026.

As this issue is now before the court, the MCK will not be able to provide further comment. As cannabis has been a sensitive issue within the community, the Ratitsénhaienhs felt it important to inform the community of the Application to Institute Proceedings for reasons of transparency.

We ask for the community’s patience and understanding as we allow the legal process to take its course.
