MCK Responds to Federal Court Application by community member doing business as “Kannabis Shop”

The Mohawk Council of Kahnawà:ke (MCK) wishes to inform the community that it has been served with a Notice of Application filed in Federal Court by a community member, doing business as “The Kannabis Shop” (TKS), against both the MCK and the Kahnawà:ke Cannabis Control Board (KCCB).

The application seeks a judicial review of the KCCB’s decision to deny TKS a standard processing licence in Kahnawà:ke. It requests that the Federal Court set aside the decision and return the matter to the KCCB or the MCK for reconsideration.

The MCK strongly refutes the allegations set out in the application and will take all necessary legal steps to oppose the proceedings.

This matter goes beyond a single application as it speaks to the integrity and authority of our community-led regulatory process. The MCK will continue to uphold and defend Kahnawà:ke’s jurisdiction and decision-making authority in all matters concerning our Territory.

This issue is now before the courts, and the MCK will not be able to provide further comment. As cannabis has been a sensitive issue within the community, the Ratitsénhaienhs felt it important to inform the community of the Notice of Application for reasons of transparency.

We ask for the community’s patience and understanding as we allow the legal process to take its course.
