Provisional injunction dismissed re: JFK Quarry G.P.

Public Service Announcement

The Mohawk Council of Kahnawà:ke (MCK) wishes to inform the community of an update in the court case filed by J.F.K. Quarry G.P. (Plaintiff) seeking a provisional injunction from the Superior Court of Quebec. The injunction was heard before a judge on Tuesday, May 5, 2026. The Plaintiff asked the court to order the MCK not to impede, obstruct, or otherwise prevent the implementation of its quarry restoration plan.

On Thursday, May 7, 2026, Justice Jean-Sébastien Vaillancourt from the Quebec Superior Court rendered an oral judgment dismissing the Plaintiff’s request for a provisional injunction. It should be noted that a provisional injunction is an exceptional short-term remedy granted in urgent situations to protect the rights of a party while a case is ongoing.

As the proceedings remain ongoing before the Superior Court for an interlocutory injunction, the MCK will not be providing further comments at this time.
