Quebec Court of Appeal update

MCK

The Mohawk Council of Kahnawà:ke (MCK) is informing the community that, on September 25, 2026, the Court of Appeal of Quebec dismissed the appeal filed by Elvin “Jason” Diabo (Appellant), a community member operating under the name Wild Wild West. MCK and Tewatohnhi’saktha presented their motions to dismiss the appeal on September 21, 2026.

In its decision, the Court of Appeal concluded that the “appeal is bound to fail and should be dismissed”. The court found that the Appellant raises a tangled web of grounds of appeal which were articulated for the first time on appeal in a generic manner. As such, the Appellant failed to identify reviewable errors in the judgement under appeal.

As part of its ongoing commitment to transparency, MCK is advising the community of this update in the present matter.
