Quebec Court of Appeal update

The Mohawk Council of Kahnawà:ke (MCK) wishes to inform the community of a hearing that took place on August 13, 2026, before a judge of the Quebec Court of Appeal during which Elvin “Jason” Diabo intended to present an Application for Leave to Appeal the Superior Court’s May 26 decision.

An Application for Leave to Appeal is a legal proceeding required in specific circumstances where an appellant must first obtain the Court of Appeal’s permission before the court can be seized of the matter.

Given the facts of the matter and the nature of the May 2026 judgment, permission of the court was not required for Mr. Diabo to file his appeal. As a result, the judge simply confirmed that the appeal had already been duly filed.

The appeal is still ongoing and the MCK will keep the community informed of further developments. As part of its ongoing commitment to transparency, the MCK is advising the community of this update in the present matter.

  • Transfer Depot will be closed
  • Recycling, compost, and cardboard pickup service will continue as usual

Regular office hours will resume on Tuesday, June 23rd, at 8:30am.

Waste Management services are as follows:

  • There will be NO Recycling and Compost collection
  • No cardboard drop offs
  • The Transfer Depot will be closed – regular Transfer Depot hours resume on Saturday, July 4th
  • Household Garbage collection will continue as usual

 

All essential services will remain in operation.

Regular business hours will resume at 8:30am on Monday, July 6th.
