The Mohawk Council of Kahnawà:ke (MCK) wishes to inform the community that, in the case The Kannabis Shop v. the Kahnawà:ke Cannabis Control Board (KCCB) and MCK (see press release dated July 31, 2025), the Federal Court dismissed the Applicant’s request under Rule 318 to force the MCK to provide documents.
The Applicant argued that the MCK worked closely with the KCCB and was effectively acting as a decision-maker and therefore should be required to provide the requested documents. The Judge rejected this argument, stating that the Kahnawà:ke Cannabis Control Law clearly separates the KCCB from the Council and that there was no evidence that the Council influenced the KCCB’s decision.
“This decision makes it clear that the Mohawk Council of Kahnawà:ke did not influence the KCCB’s ruling, and there is no evidence to suggest otherwise,” said Ohén:ton Í:rate ne Ratitsénhaienhs Cody Diabo. “In rejecting the Applicant’s attempt to compel disclosure, the Court confirmed that the Board operates independently.”
The Applicant was ordered to pay the MCK’s legal costs for this motion.
